Explanation of Dispute Resolution Options:
Dispute resolution is a term that refers to a number of processes that can be used to resolve a conflict, dispute or claim. Dispute resolution may take the form of formal litigation or an alternative dispute resolution process, or ADR for short. ADR’s are alternatives to court (state or federal judge or jury) which decides the dispute by a trial. ADR often takes the form of negotiation, mediation, or arbitration (binding or non-binding). ADR processes can be used to resolve any type of dispute including family, neighborhood, employment, business, housing, personal injury, consumer, and environmental disputes.
ADR is considered faster and less expensive than formal litigation. However, utilizing a binding ADR process, such as arbitration, can significantly limit the discovery, and the resulting decisions are very difficult to overturn on appeal. While they may be quicker overall, ADR’s can frequently cost as much or more than formal litigation due to additional administrative fees and meeting the arbitrator’s hourly rate (or arbitrators if arbitration by panel). Thus, there are times when litigation in court is more advantageous than a binding ADR process.
